LEGAL

This Agreement is made between Proxyden Limited trading as Escapeden (the “Company”) and the Hirer named in the booking confirmation (the “Hirer”).

This Agreement is structured into Schedules which together form the full contractual terms.


SCHEDULE 1 – DEFINITIONS AND COMPANY INFORMATION

1.1 Company: Proxyden Limited trading as Escapeden.

1.2 Company Registration Details: Company No. 16344046, registered office at 86 TALA CLOSE, SURBITON, ENGLAND, KT6 7EY.

1.3 VAT Number: 489414450.

1.4 Hirer: The person(s) named in the booking confirmation.

1.5 Vehicle: Camper van provided under this Agreement.

1.6 Hire Commencement: Date/time vehicle is handed over and keys released.

1.7 Rental Period: Agreed hire duration in booking confirmation.

1.8 Total Hire Charge: Total rental cost excluding refundable deposit.

1.9 Reasonable Costs: Costs actually incurred, necessary, proportionate, and evidenced at prevailing market rates.

1.10 Material Breach: A serious breach affecting safety, legality, insurance validity, or proper use including non-payment, misuse, unauthorised drivers, or invalid insurance conditions.


SCHEDULE 2 – BOOKING, PAYMENT, CANCELLATION AND FINANCIAL TERMS

2.1 A 50% deposit is required to secure booking.

2.2 Full payment due 8 days before Hire Commencement.

2.3 Bookings within 8 days require full payment immediately.

2.4 Insurance verification must be completed within 3 days of booking, and no less than 48 hours before the hire period in the case of late bookings.

2.5 Insurance failure may result in cancellation with £100 admin fee deduction.

2.6 Cancellation terms:

  • More than 30 days: refund minus £100 admin fee
  • 14–30 days: 50% payable
  • 13–8 days: 75% payable
  • Less than 8 days: 100% payable

2.7 No refunds after Hire Commencement.

2.8 If the vehicle is unavailable due to fault / repair the company will provide a full refund regardless of timing.


SCHEDULE 3 – VEHICLE USE, OPERATIONAL CONDITIONS AND RESPONSIBILITIES

3.1 Only drivers who have signed the terms and the end of this document and pass the insurance verification may drive the Vehicle.

3.2 Drivers must be 30–75 with valid licence held 2+ years.

3.3 Vehicle must not be used illegally, off-road, or under influence of drugs or alcohol.

3.4 Mileage allowance: 150 miles per day average.

3.5 Excess mileage: £2.20 per mile.

3.6 Fuel must be returned at same level as pickup

3.7 Vehicle condition will be recorded at handover and must be return in the same condition.

3.8 Cleaning must be reasonable; excessive cleaning charged – i.e mud, stains, ingrained dirt, excessive pet hair etc.

3.9 Occupancy must not exceed insured limits.

3.10 EU travel only with written permission.

3.11 Vehicle fitted with GPS tracker for security, compliance and recovery. Hirer consents to tracking.

3.12 Force majeure events exclude Company liability (weather, strikes, disruption).

3.13 Roadside assistance included via VW, replacement vehicle not guaranteed.


SCHEDULE 4 – FINANCIAL TERMS, DEPOSIT, LIABILITY AND ENFORCEMENT

4.1 £1,000 security deposit required via BACS from an account named the same as the main driver.

4.2 Deposit must clear 48 hours before Hire Commencement.

4.3 Joint liability applies to the main and additional drivers.

4.4 Deposit may be retained pending inspection or dispute.

4.5 Independent repair quotes may be obtained.

4.6 Deposit will be refund within 7–14 days subject to satisfactory inspection.

4.7 Deposit retention capped at 20 days unless dispute is ongoing.

4.8 Deductions limited to Reasonable Costs only.

4.9 Outstanding sums may be recovered as civil debt.

4.10 All discretion exercised reasonably and proportionately.


SCHEDULE 5 – INSURANCE, BREACH, TERMINATION AND HIRE PACK

5.1 Comprehensive insurance included unless stated.

5.2 Standard excess applies.

5.3 Insurance void if Material Breach occurs.

5.4 Company may terminate hire immediately for Material Breach or unsafe use.

5.5 Hirer remains liable for charges where termination results from breach.

5.6 Evidence (photos, GPS, telematics) may be used in disputes.

5.7 Hire Pack forms part of this Agreement and includes:

  • Booking Confirmation
  • Pre-hire condition report
  • Post-hire condition report
  • Return checklist

5.8 All Hire Pack documents form contractual evidence.


SCHEDULE 6 – CUSTOMER DECLARATION (DRIVING FITNESS, LICENCE AND CONVICTIONS)

6.1 The Hirer confirms and declares that all information provided to the Company is true, complete, and not misleading.

6.2 The Hirer declares that they hold a valid driving licence that is not suspended, revoked, or subject to disqualification.

6.3 The Hirer declares that they have not been disqualified from driving within the last 5 years.

6.4 The Hirer confirms they have disclosed all current penalty points, driving convictions, endorsements, or pending prosecutions relevant to driving.

6.5 The Hirer confirms they are medically fit to drive and have no condition that would impair their ability to safely operate the Vehicle, including but not limited to conditions requiring notification to the DVLA that have not been declared.

6.6 The Hirer confirms they will not be under the influence of alcohol, drugs, or medication that may impair driving at any point during the Hire Period they are in charge of the vehicle.

6.7 The Hirer agrees to immediately notify the Company if their driving licence status, medical fitness, or legal eligibility to drive changes before or during the Hire Period.

6.8 The Hirer acknowledges that the Company relies on this declaration when providing insurance cover and Vehicle hire.

6.9 The Hirer understands that any false declaration constitutes a Material Breach of this Agreement and may result in immediate termination, forfeiture of deposit, and liability for all resulting losses.

6.10 The Hirer consents to the Company conducting insurance eligibility verification, including but not limited to, address verification and driving license checks.

GENERAL TERMS

A. Entire Agreement: This document and schedules form the entire agreement.

B. Severability: Invalid provisions do not affect remainder.

C. Interpretation: Ambiguity interpreted in line with UK consumer law.

D. Order of Precedence: Schedules prevail over general statements where conflict arises.

3. How We Use Your Data

To manage bookings and provide hire services

To verify driver eligibility and obtain insurance cover

To monitor vehicle use and ensure compliance with hire terms

To recover vehicles and prevent theft or misuse

To comply with legal and regulatory obligations


4. Legal Basis for Processing

We rely on the following legal bases under UK GDPR:

Contractual necessity – to perform the hire agreement

Legal obligation – for tax, insurance, and regulatory compliance

Legitimate interests – to operate and protect our business (e.g. GPS tracking, fraud prevention)

Consent – where required (e.g. marketing communications, cookies)


5. GPS Tracking and Vehicle Monitoring

All vehicles are fitted with GPS tracking devices.

We use tracking data to:

Protect against theft and recover vehicles

Monitor compliance with hire terms

Verify mileage and usage

Assist in emergencies

This processing is based on legitimate interests and is proportionate to protect our assets and customers.


6. Sharing Your Data

We may share your data with:

Insurance providers (for validation of cover)

Payment processors

Government authorities (e.g. DVLA, law enforcement, where required)

Service providers (IT systems, booking platforms)

We do not sell your personal data.


7. Data Retention

We retain personal data only as long as necessary:

Booking and financial records: up to 6 years (HMRC requirement)

Insurance and incident records: up to 6 years

Website analytics data: typically up to 26 months


8. Your Rights

Under UK GDPR, you have the right to:

Correct inaccurate data

Request deletion (where applicable)

Restrict processing

Object to processing

Data portability

You also have the right to complain to the Information Commissioner’s Office (ICO).
